Terms and Conditions for SleepYou

Welcome to SleepYou! These Terms of Service ("Terms") apply to your use of the SleepYou mobile application and https://sleepyou.top (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1) What SleepYou Provides
SleepYou is a privacy-first sleep tracking and coaching service that offers sleep stage detection, smart alarms, optional snoring detection, sleep trends, and AI-powered recommendations. Core analysis happens on your device; some features may require an account or subscription.

2) Accounts
- Account optional: you can use core tracking without an account. Premium features and encrypted backups may require an account.
- Accuracy: provide accurate information and keep credentials secure.
- Termination: you may delete your account at any time; we may suspend or terminate accounts for misuse or legal reasons. Data associated with your account will be deleted from our systems within 30 days of a verified request, subject to legal obligations.

3) Subscriptions and Payments
- Plans: Free tier includes core tracking. Premium may include AI Sleep Coach, unlimited history, snoring analysis, advanced analytics, data export, and priority support.
- Pricing: displayed in-app or on our website and may vary by region. We will give notice before material pricing changes.
- Billing: payments are processed by Apple App Store, Google Play Store, or Stripe. Auto-renewing subscriptions bill each period unless canceled at least 24 hours before renewal (or as your platform allows).
- Cancellations: manage subscriptions through the platform where you purchased (App Store, Google Play, or the SleepYou web billing portal). Access to Premium ends at the end of the paid period.
- Refunds: for web purchases, request a refund within 7 days by emailing bartzalewskidev@gmail.com with proof of purchase. App Store and Google Play purchases follow their policies.

4) Acceptable Use
Do not misuse the Service. In particular, you will not:
- Violate laws or infringe others' rights;
- Attempt to reverse engineer or interfere with the Service;
- Upload malicious code or disrupt the Service;
- Misrepresent your identity or use the Service for commercial resale.

5) Health Disclaimer
SleepYou is not a medical device and does not provide medical advice. Do not use the Service to diagnose or treat health conditions. Consult a qualified healthcare professional for medical concerns.

6) Intellectual Property and Licenses
- Our rights: SleepYou owns the Service and related content, logos, and technology.
- Your data: you own your sleep data. When you enable optional backup or other cloud features, you grant us a limited license to store and process encrypted data solely to provide the Service. This license ends when data is deleted.
- Your license: we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal purposes.

7) Privacy
Our Privacy Policy (https://sleepyou.top/privacy-policy) explains how we handle data. By using the Service, you consent to those practices.

8) Third-Party Services
The Service may link to or rely on third parties (e.g., Apple, Google, Stripe, backup hosting, analytics). Their terms and privacy policies govern your use of those services. We are not responsible for third-party services.

9) Updates to the Service and Terms
We may update features or these Terms. Material changes will be communicated via email, in-app notice, or on the website. Continued use after changes means you accept the updated Terms.

10) Limitation of Liability
To the maximum extent permitted by law, SleepYou is provided "as is" without warranties, and our liability to you is limited to the amount you paid to SleepYou in the 12 months before the claim or $100, whichever is less. We are not liable for indirect, consequential, or special damages.

11) Indemnification
You agree to indemnify SleepYou and its affiliates against claims arising from your use of the Service, violation of these Terms, or infringement of others' rights.

12) Governing Law and Disputes
These Terms are governed by the laws of France, without regard to conflicts of law. Courts located in France will have exclusive jurisdiction, subject to mandatory local law. Please contact bartzalewskidev@gmail.com first to try to resolve disputes informally.
